Terms of Service
These Terms of Service (“Terms”) govern access to and use of the Communfy platform (the “Service”) provided by Quorien Shift LLC, a limited liability company registered in Wyoming, USA, 30 N Gould St, STE R, Sheridan, WY 82801, USA. By using the Service or creating an account you agree to these Terms. You must be at least 18 years old and able to enter into a binding contract to use the Service.
Communfy is software for communal-fee and building management. Management companies and the committees of self-managed buildings use it to manage buildings, units, owners, budgets, invoices, payments, expenses and maintenance; owners and tenants use it to view their accounts, report issues and pay online.
1. Accounts
Accounts are created for management companies, for the committees of self-managed buildings, and for the owners and tenants they invite. You are responsible for the accuracy of the information you enter, for keeping credentials confidential, and for all activity under your account. Notify us promptly of any unauthorised use.
2. Acceptable use
You agree not to misuse the Service: no unlawful content, no fraudulent or misleading documents or records, no attempts to breach security or access data you are not authorised to see, no scraping or automated extraction, no reverse engineering except as permitted by law, and no use that disrupts the Service for others.
3. Customer data
As between the parties, data entered by a management company or building committee and its residents remains theirs. You grant us a limited licence to host, process and back up that data solely to provide the Service. Our handling of personal data is described in the Privacy Policy, which forms part of these Terms.
4. Intellectual property
The Service, including its software, databases, designs and the Communfy name and branding, belongs to Quorien Shift LLC. Apart from the right to use the Service under these Terms, no rights are granted to you, and you may not copy or reuse any part of it without our written permission. Content you upload remains yours.
5. Payments
Online owner and tenant payments are processed by Stripe directly into the management company’s or building committee’s own Stripe account. Communfy does not receive, hold or transfer these funds and charges no fee on them; the account holder is the merchant for these payments. Communfy is not a bank, payment institution, money transmitter or escrow agent, and is not a party to the arrangements between the account holder and its owners or tenants. Payment failures, disputes, refunds and chargebacks are between the payer and the account holder. You are responsible for any taxes on amounts you bill through the Service.
6. Communfy subscription
Merchant of record. Communfy subscriptions are sold, processed and invoiced by our reseller and merchant of record, Link, LLC (Lemon Squeezy, a Stripe company). Link, LLC appears as the seller on checkout and on your receipts, and charges any applicable VAT or sales tax based on your location.
Price. The fee is based on the number of units you manage across all your buildings, subject to a monthly minimum, at the rates shown on our pricing page. Annual billing costs ten times the monthly fee. Prices exclude VAT.
Free trial. New accounts get one 30-day free trial. A payment card is required to start it. If you cancel before the trial ends you are not charged; otherwise the first payment is taken when the trial ends.
Renewal and cancellation. Subscriptions renew automatically each month or year until cancelled. You can cancel at any time from the billing portal; cancelling stops future renewals and you keep access until the end of the period already paid for.
Changes in units. When you add or remove units, your subscription is updated automatically. On monthly billing the prorated difference is added to or credited against your next invoice. On annual billing, added units are prorated and invoiced straight away, and removed units take effect from your next renewal.
Right of withdrawal. If you subscribe as a consumer in the EU/EEA or the UK, you may withdraw from the subscription within 14 days of entering into it, without giving a reason, by cancelling in the billing portal or emailing us. Cancelling during the free trial costs nothing. If you withdraw within 14 days of a paid subscription starting, the payment is refunded less a proportionate amount for the days the Service was provided at your request.
Refunds. Apart from the right of withdrawal above, payments already made are non-refundable, including for partial periods, except where required by law or where we choose to issue a refund at our discretion.
Price changes. Prices may change with at least 30 days’ notice, taking effect from your next renewal.
7. Availability
We aim to keep the Service available but do not guarantee uninterrupted operation. We may modify, suspend, or discontinue features with reasonable notice where practicable.
8. Warranties & liability
The Service is provided “as is” and “as available” without warranties of any kind, including as to uninterrupted availability or security, to the extent permitted by law. Communfy is not liable for indirect, incidental, or consequential damages, or for loss of profits or data. Nothing in these Terms limits liability that cannot be limited under applicable law. Our total aggregate liability is limited to the amounts you paid for the Service in the twelve months before the claim.
9. Financial figures
The Service assists with communal-fee accounting but does not constitute accounting, tax, or legal advice. You are responsible for verifying budgets, invoices, VAT treatment, and financial reports before relying on or issuing them.
10. Termination
You may cancel your subscription and close your account at any time. We may suspend or terminate an account for a material breach of these Terms, with notice where practicable. After closure, data is deleted from our production systems within 30 days, so export anything you need first; financial records may be kept longer where the law requires.
11. Changes
We may update these Terms; material changes will be notified through the Service or by email at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
12. Governing law
These Terms are governed by the laws of the State of Wyoming, USA, excluding its conflict-of-law rules, and the courts located there have exclusive jurisdiction. This does not affect any mandatory protections you have under the law of the country where you live.
